These Terms of Service (“Terms”) govern your access to and use of the SawFleet website, applications, marketplace tools, and related services (collectively, the “Platform”).

By accessing or using the Platform, you agree to be legally bound by these Terms. If you do not agree, you may not use the Platform.

2. Nature of the Platform

SawFleet operates as a technology marketplace that connects:

• Tree service companies
• Grapple saw operators
• Equipment providers
• Property owners
• Contractors and related service professionals

SawFleet does not:

• Provide tree removal services
• Employ operators or contractors
• Own or lease equipment listed on the Platform
• Supervise field work
• Guarantee project outcomes

SawFleet serves solely as a neutral facilitator for introductions, listings, communications, and transactions between independent parties.

3. Eligibility

To use the Platform, you must:

• Be at least 18 years old
• Have legal capacity to enter contracts
• Use the Platform for lawful business purposes

By using the Platform, you represent that you meet these requirements.

4. User Accounts

A. Account Registration

Users may be required to create an account. You agree to:

• Provide accurate and current information
• Maintain the security of login credentials
• Accept responsibility for activities under your account

B. Account Termination

SawFleet may suspend or terminate accounts at any time for:

• Violations of these Terms
• Fraudulent or abusive behavior
• Safety or legal concerns
• Misrepresentation of services

5. Marketplace Transactions

A. Independent Parties

All transactions, agreements, and services arranged through the Platform occur solely between users.

SawFleet is not a party to contracts between:

• Operators and customers
• Equipment owners and renters
• Contractors and subcontractors

B. No Employment Relationship

Nothing in these Terms creates:

• Employer–employee relationships
• Partnerships
• Joint ventures
• Agency relationships

All service providers operate as independent contractors.

C. User Responsibility

Users are solely responsible for:

• Licensing and certifications
• Insurance coverage
• Equipment safety
• Compliance with laws and regulations
• Permits and site approvals
• Contract negotiation and performance

6. Prohibited Conduct

Users may not:

• Provide false or misleading information
• Engage in unsafe or illegal services
• Violate licensing or insurance requirements
• Harass or threaten others
• Interfere with platform security
• Use bots, scrapers, or automated data collection
• Copy or exploit platform content without permission
• Bypass communication systems to avoid fees

SawFleet reserves the right to investigate and remove content or users engaging in prohibited conduct.

7. User Content

Users may post listings, profiles, photos, descriptions, reviews, and communications (“User Content”).

You grant SawFleet a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute User Content for platform operations and marketing.

Users are solely responsible for the accuracy and legality of their content.

SawFleet may remove content at its discretion.

8. Reviews & Ratings

SawFleet may allow users to submit ratings and reviews.

Reviews must:

• Be truthful
• Reflect actual experiences
• Avoid defamatory or unlawful statements

SawFleet may remove reviews that violate policies.

9. Intellectual Property

All Platform content including logos, branding, software, design, databases, and materials are owned by SawFleet or its licensors and protected by intellectual property laws.

Users may not copy, modify, distribute, sell, or reverse engineer any part of the Platform.

10. Privacy

Use of the Platform is also governed by our Privacy Policy, incorporated by reference.

11. Third-Party Services

The Platform may contain links to third-party services or tools.

SawFleet is not responsible for third-party:

• Content
• Services
• Transactions
• Data practices

Use of third-party services is at your own risk.

12. Disclaimers

A. Platform Provided “As Is”

The Platform is provided “as is” without warranties of any kind.

SawFleet disclaims all warranties, express or implied, including:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Availability or uninterrupted access

B. No Service Guarantees

SawFleet does not guarantee:

• Quality of work
• Contractor reliability
• Equipment condition
• Project outcomes
• Pricing accuracy

Users assume all risks related to services arranged through the Platform.

13. Limitation of Liability

To the fullest extent permitted by law, SawFleet shall not be liable for:

• Indirect or consequential damages
• Loss of profits or business opportunities
• Property damage
• Personal injury
• Disputes between users
• Errors or interruptions of service

SawFleet’s total liability shall not exceed the amount paid by the user to SawFleet in the preceding 12 months.

14. Indemnification

Users agree to indemnify and hold harmless SawFleet and its officers, employees, and affiliates from claims arising out of:

• User conduct
• Services performed
• Violations of law
• Breach of these Terms
• Property damage or injury
• Contract disputes

15. Dispute Resolution & Arbitration

A. Binding Arbitration

Disputes shall be resolved by binding arbitration rather than court proceedings, except for small claims matters.

B. Class Action Waiver

Users waive rights to participate in class actions.

C. Governing Law
